{"id":14133,"date":"2024-05-07T13:59:24","date_gmt":"2024-05-07T17:59:24","guid":{"rendered":"https:\/\/jfcy.org\/en\/?post_type=jfcy-in-the-courts&#038;p=14133"},"modified":"2026-03-18T11:05:56","modified_gmt":"2026-03-18T15:05:56","slug":"fair-change","status":"publish","type":"jfcy-in-the-courts","link":"https:\/\/jfcy.org\/en\/cases-decisions\/fair-change\/","title":{"rendered":"Fair Change v Ontario [Safe Streets Act challenge]"},"content":{"rendered":"\n<p>JFCY intervened in the <em>Charter<\/em> challenge of Ontario\u2019s <em>Safe Streets Act<\/em>.\u00a0 On April 2, 2024 the Ontario Superior Court of Justice found that the <em>Safe Streets Act<\/em> violates the <em>Charter<\/em> freedoms of unhoused people living in poverty. The Court restricted the law\u2019s overbroad definitions of \u201caggressive\u201d panhandling and soliciting and struck down the majority of the law\u2019s restrictions against panhandling in certain locations, such as outside of ATMs or at transit stops. JFCY filed a factum and made submissions to draw the Court\u2019s attention to the lived experience of young people who are homeless or precariously housed and highlighted the particular evidentiary and legal contexts that heightened the impact of the <em>Safe Streets Act<\/em>\u2019s infringements of the <em>Charter<\/em> rights of children and young people who panhandle. Lawyers at JFCY have been advocating in various capacities for the repeal of the <em>Safe Streets Act<\/em> since the law\u2019s enactment in 1999.
