JFCY will be intervening before the Supreme Court of Canada in a case that could reshape how Canadian law acknowledges family violence.

The novel tort of family violence aims to give survivors a civil law remedy that acknowledges their experiences and provides a financial remedy. The Supreme Court of Canada will decide later this year if this tort is necessary and appropriate to address the harms caused by patterns of coercion and control.

As interveners, JFCY will argue that children’s rights, views, and needs must be prioritized when addressing family violence. By putting forward children’s unique perspectives, JFCY seeks to promote their dignity, agency, and access to justice in a system often focused on adult needs.
